TERMS OF SERVICE

Please read these Terms of Service carefully before using the Avarice Fitness website or purchasing any products or services. By accessing our website or making a purchase, you agree to be bound by these terms. 

 

1. Acceptance of Terms 

By accessing avaricefit.com or purchasing any Avarice Fitness product or service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our website or services. 

 

2. Services Offered 

Avarice Fitness offers the following services: 

  • Digital fitness programs (downloadable and membership-based) 

  • Online 1-on-1 personal coaching subscriptions 

  • Apparel and merchandise 

  • Supplement products (when available) 

  • Free program downloads in exchange for email registration 

 

3. Eligibility 

You must be at least 18 years of age to purchase services from Avarice Fitness. By making a purchase, you represent that you are 18 or older, or that you have obtained parental/guardian consent as required by our Client Agreement. 

 

4. User Accounts 

Some services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. 

 

5. Intellectual Property 

All content on avaricefit.com — including training programs, videos, graphics, text, branding, and design — is the exclusive property of MBDY LLC, doing business as Avarice Fitness and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent. 

 

6. Health & Fitness Disclaimer 

IMPORTANT: The fitness programs, coaching services, and nutritional information provided by Avarice Fitness are for educational and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified physician before beginning any new exercise or nutrition program, especially if you have any pre-existing health conditions. Avarice Fitness coaches are fitness professionals, not licensed medical providers. 

 

7. Assumption of Risk 

Participation in any fitness program involves inherent risks including but not limited to physical injury, muscle soreness, and in rare cases, more serious injury or illness. By purchasing and participating in any Avarice Fitness program or coaching service, you voluntarily assume all such risks. 

 

8. Payment Terms 

All prices are listed in US dollars. Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout. All transactions are processed securely through Stripe. 

 

9. Refund Policy 

All sales are final. Please refer to our full Refund Policy for complete details. 

 

10. Cancellation Policy 

Subscription services require 30 days written notice to cancel. Please refer to your signed Client Agreement for full cancellation terms. 

 

11. Prohibited Conduct 

You agree not to: 

  • Share, resell, or distribute any purchased program content 

  • Use our services for any unlawful purpose 

  • Attempt to gain unauthorized access to our systems 

  • Post false, misleading, or defamatory content about Avarice Fitness 

  • Engage in any conduct that disrupts or interferes with our services 

 

12. Limitation of Liability 

To the maximum extent permitted by law, MBDY LLC, doing business as Avarice Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim. 

 

13. Governing Law 

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in San Diego County, California. 

 

14. Changes to Terms 

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.
