RETAIL TERMS OF SERVICE 

Applicable to: Apparel & Supplement Purchases Only

These Retail Terms of Service govern the purchase of physical and digital retail products — including apparel, accessories, and supplements — from Avarice Fitness at avaricefit.com. By completing a purchase you agree to these terms. These terms do not apply to coaching services, training programs, or memberships, which are governed by the Avarice Fitness Client Services Agreement. 

 

1. Who We Are 

Avarice Fitness is a brand operated by MBDY LLC, doing business as Avarice Fitness, based in Del Mar, California. For questions contact us at support@avaricefit.com. 

 

2. Products 

We offer the following retail product categories: 

  • Apparel — t-shirts, hoodies, shorts, sports bras, biker shorts, hats, and accessories 

  • Supplements — pre-workout, protein, creatine, and related nutritional products (when available) 

  • Accessories — stickers, bags, and branded gear 

 

Product descriptions, images, and pricing are subject to change without notice. We reserve the right to discontinue any product at any time. 

 

3. Sizing & Fit 

We provide sizing guides on each product page. Sizes may vary between styles and manufacturers. We strongly recommend reviewing the size guide before purchasing. We are not responsible for purchases made in the wrong size if a size guide was available at the time of purchase. 

 

4. Pricing & Payment 

All prices are listed in US dollars and are inclusive of applicable taxes where required by law. Payment is collected at the time of purchase. We accept all major credit cards, debit cards, and any additional payment methods displayed at checkout, processed securely through Shopify Payments and Stripe. 

 

We reserve the right to cancel any order in the event of a pricing error. In such cases, you will be notified and offered a full refund. 

 

5. Order Processing & Shipping 

Orders are typically processed within 2–5 business days. Shipping times vary based on your location and the shipping method selected at checkout. Once your order ships you will receive a tracking number via email. 

 

Avarice Fitness is not responsible for delays caused by carriers, customs, or circumstances outside our control. Risk of loss passes to you upon delivery to the carrier. 

 

  • Domestic shipping: 3–7 business days after processing 

  • International shipping: 7–21 business days after processing 

  • Expedited shipping options available at checkout where offered 

 

6. Returns & Exchanges 

ALL SALES ON DIGITAL PRODUCTS AND SUPPLEMENTS ARE FINAL AND NON-REFUNDABLE. Apparel returns are accepted under the conditions below only. 

 

We accept returns on unworn, unwashed apparel in original condition with tags attached, submitted within 14 days of delivery. To initiate a return: 

  • Email support@avaricefit.com with your order number and reason for return 

  • We will provide a return shipping label or instructions within 2 business days 

  • Approved returns receive store credit only — no cash refunds 

  • Customer is responsible for return shipping costs unless the item is defective 

  • Final sale and clearance items are not eligible for return 

 

7. Damaged or Defective Items 

If you receive a damaged or defective item, contact support@avaricefit.com within 7 days of delivery with your order number and photos of the damage. We will replace the item or issue store credit at our discretion. We do not offer cash refunds on damaged items. 

 

8. Supplements — Additional Terms 

Supplement products are intended for use by healthy adults 18 years of age or older. Before using any supplement, consult with a qualified healthcare provider, particularly if you are pregnant, nursing, have a medical condition, or are taking medication. 

 

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. 

 

Supplement sales are final and non-refundable once shipped due to the nature of consumable products. If you receive a damaged or tampered supplement product, contact us within 7 days of delivery. 

 

9. Intellectual Property 

All Avarice Fitness branding, graphics, designs, and product artwork are the exclusive property of MBDY LLC, doing business as Avarice Fitness, and are protected by applicable intellectual property laws. You may not reproduce, copy, or use our branding without prior written consent. 

 

10. Limitation of Liability 

To the maximum extent permitted by law, Avarice Fitness shall not be liable for any indirect, incidental, or consequential damages arising from your purchase or use of our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. 

 

11. Governing Law 

These Retail Terms are governed by the laws of the State of California. Any disputes shall be resolved in San Diego County, California. 

 

12. Changes to These Terms 

We may update these Retail Terms at any time. Changes take effect upon posting to our website. Your continued purchases after changes are posted constitute acceptance of the updated terms.
